Terms and conditions

1. Scope of application These general conditions of sale apply to all orders placed on the website www.chemindesapprenticeship.be (hereinafter "the Site") published by Claire Simons hereinafter "the Seller").

2. Orders The customer can place an order on the Site by completing the online order form. The Seller reserves the right to refuse any order for legitimate reasons such as non-compliance with these general conditions of sale, unavailability of the product, a previous dispute with the customer, etc.

3. Price and payment

The prices displayed on the Site are indicated in euros, all taxes included. The Seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of validation of the order. Payment is made by credit card, bank transfer or any other means of payment accepted by the Seller. The customer guarantees to the Seller that he has the authorizations possibly necessary to use the payment method chosen when ordering.

4. Delivery

The products are delivered to the delivery address indicated by the customer when ordering. The Seller undertakes to make delivery within the deadlines indicated on the Site. In the event of late delivery, the customer has 30 days from the scheduled delivery date to cancel their order. The risks associated with transport are borne by the Seller until delivery of the products to the customer.

5. Right of withdrawal

The customer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to provide reasons or pay penalties. The Seller will then reimburse the customer as soon as possible and at the latest within 14 days following receipt of the returned products. The customer must return the products at his own expense and under his responsibility, in their original condition, complete and accompanied by all possible accessories.

6. Warranty

The Seller guarantees the products against any lack of conformity or operation for a period of 2 years from the date of delivery. The customer must inform the Seller in writing of any defect as soon as possible following its discovery. The customer may request replacement or repair of the products, subject to the availability of parts and the agreement of the Seller.

7. Liability

The Seller cannot be held responsible for direct or indirect damage caused by the use of the products sold on the Site. The Seller cannot also be held responsible for delays or disruptions in delivery attributable to postal services or carriers. The Seller's liability is limited to the amount of the order.

8.Intellectual property

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of the Seller or its partners. Any reproduction, representation or partial or total exploitation of the elements of the Site is prohibited without the prior written authorization of the Seller.

9. Protection of personal data

The Seller undertakes to respect the privacy of its customers and to protect the personal information communicated to them. The data collected is used only within the framework of the commercial relationship between the Seller and the customer and is under no circumstances transmitted to third parties without the prior consent of the customer.

10. Disputes and applicable law

Any dispute relating to the sale of products on the Site will be subject to Belgian law. In the event of a dispute, the parties will attempt to find an amicable solution. Failing this, the Belgian courts will have sole jurisdiction to resolve the dispute.

11. Changes to the general conditions of sale

The Seller reserves the right to modify these general conditions of sale at any time. The applicable conditions are those in force at the time the order is placed.

13. Miscellaneous provisions

If any provision of these terms and conditions of sale is held to be illegal, invalid or unenforceable for any reason, such provision shall be deemed null and void, but this will not affect the validity of the other provisions of the terms and conditions of sale .

The fact that the Seller does not avail itself at a given time of one of the provisions of these general conditions of sale cannot be interpreted as a waiver to subsequently avail itself of any of these provisions.

These general conditions of sale are governed and interpreted in accordance with Belgian law. Any dispute or claim arising from or in connection with these general conditions of sale will be subject to the exclusive jurisdiction of the courts of Tongeren.

By accepting these general conditions of sale, the customer declares to have read these general conditions of sale and to have accepted them without reservation. These general conditions of sale constitute the entire agreement between the Seller and the customer and supersede all prior or contemporaneous agreements or understandings, written or oral, relating to the subject matter hereof.
